General Information

These Terms and Conditions (“Terms”) govern the services provided by Bizzy Brander (“we,” “us,” “our”) and may also apply to services provided under the name of Hardie Duhaney II. By engaging our services, you (“client,” “you,” “your”) agree to comply with these Terms.

Services Offered:
We specialize in image editing and may also provide video editing and audio editing services on a case-by-case basis.

Target Audience:
Our services are available to both businesses and individuals, including photographers, real estate agents, and anyone needing image editing services.



Payment and Pricing


Payments
:

  • For projects over $20, a 25% non-refundable retainer is required to begin work.
  • For projects under $20, no retainer is required. Full payment will be invoiced upon client approval of the proof of concept and is due immediately upon receipt to continue the project.
  • Final payment for projects over $20 will be invoiced after client approval of the proof of concept and must be paid before further work continues or final deliverables are provided.
  • Payments are processed through Zoho invoicing (using Stripe). We also accept PayPal, Zelle, Venmo, Apple Pay, and Cash App.

Refunds and Cancellations:

  • Retainers are non-refundable under all circumstances.
  • For projects under $20, payments are non-refundable once work begins or proof of concept approval is provided.
  • Refunds for unsatisfactory work on projects over $20 will only be issued for amounts exceeding the retainer after a minimum of three revisions.
  • Both parties must agree to cancel the project.

Revisions:

  • Two revisions per image are included for Hand-Crafted services.
  • Additional revisions will incur charges equivalent to the original base price of the image, based on tier or complexity.


Deliverables and Intellectual Property


Deliverables
:

  • Final files will be delivered in formats specified in the contract or based on the client’s submission format.
  • Clients may request visual updates during the project within reasonable limits.
  • Proof of Concept: A proof of concept will be provided to the client early in the project to demonstrate our ability to execute the required work. This proof may consist of a sample or portion of an edited image. The scope and content of the proof of concept are determined solely by Bizzy Brander, and its approval by the client is required to proceed. Full payment is required upon proof of concept approval to continue project development.

Ownership and Licensing:

  • Clients typically own full rights to the delivered work unless the contract states otherwise.
  • If we substantially alter or provide assets, Bizzy Brander reserves the right to retain some rights to the modified work.
  • Restrictions on usage or redistribution may apply if licensing terms are specified in the contract.

Non-Returnable Digital Goods:

  • All delivered digital files are non-returnable and non-refundable.


Timeline and Deadlines


Turnaround Time
:

  • Project deadlines are estimates and may vary based on workload or unforeseen circumstances.
  • Clients will be promptly notified of any delays.

Delays:

  • If payment for the remaining balance is delayed after proof of concept approval, project timelines may be extended or paused until payment is received.


Client Responsibilities


Image Submission
:

  • Clients must ensure submitted files are suitable for editing. Files should not exceed 8MB; exceptions may be accommodated.
  • Clients are solely responsible for having legal rights to submitted images. Bizzy Brander is not liable for any claims arising from unauthorized use of submitted files.


Liability and Limitations


Liability
:

  • We are not liable for errors in client-submitted files, such as low-quality images or incomplete data.
  • Bizzy Brander’s liability is limited to the amount paid for the specific project.

Errors and Corrections:

  • Errors reported during the revision process will be corrected at no additional cost.
  • Once a project is marked as final by the client, additional changes will require payment.

Communication and Disputes

Dispute Resolution:

  • Disputes will be resolved through mediation or arbitration in California. If unresolved, disputes may be escalated to small claims court.

Final Details


Governing Law
:

  • These Terms are governed by the laws of the State of California.

Updates:

  • We reserve the right to update these Terms at any time. Updates will be posted on our website. Significant changes may be communicated via email, if we have your contact information.
